Terms

1.1. This Statute was developed in accordance with the legislation of Ukraine and is a document regulating the activities of the institution of higher education, the Private organization (institution, institution) of the Odessa International Academy (hereinafter – the Academy).

1.2. The Academy is guided in its activities by the Constitution of Ukraine, the Laws of Ukraine “On Education”, “On Higher Education”, “On Scientific and Scientific-Technical Activities”, normative legal acts of the Cabinet of Ministers of Ukraine, the Ministry of Education and Science of Ukraine, other acts on education issues , this Statute.

1.3. The Academy is based on a private form of ownership, created on the basis of the decision of the founders No. 1 of August 15, 2018 and ensures the realization of the needs of a person and a citizen in obtaining education.

1.4. The founder of the Academy is Pakhlevanzadeh Alborz, taxpayer identification code 3406111195.

1.5. Name of the legal entity:

1.6. Location and contacts of the Academy:

Ukraine, 67822, Odesa, Odesa region, Ovidiopol district, Novodolynska village council, GO “Lebid”, 14 Liniya street, building 2a.

1.7. The Academy is a legal entity under private law, has its own seal, stamps and forms, signboard, other details, accounts, independent balance sheet, estimate, symbols and attributes of a legal entity, has the right to acquire property and personal non-property rights on its own behalf, have obligations, to be a plaintiff, a defendant and a third party in court. The Academy acquires the status of an institution of higher education from the moment of obtaining a license to conduct educational activities.

1.8. The civil legal capacity of the Academy arises from the moment of its state registration and consists of its rights and obligations. The duties of the Academy are realized through the duties of the founder, rector and participants in the educational process.

1.9. The Academy is a non-profit institution of higher education (institution). The Academy operates on a non-profit basis.

1.10. The Academy was created to provide services for citizens of Ukraine, foreigners and stateless persons to receive education on a paid basis, to conduct scientific research, as well as to carry out other activities defined by this Statute and not prohibited by the requirements of the legislation of Ukraine.

1.11. Structural subdivisions of the Academy are created in accordance with the legislation of Ukraine and the main tasks of the Academy’s activities, and function in accordance with separate provisions.

 

1.12. The main areas of activity of the Academy are:

conducting high-level educational activities for persons to obtain a corresponding degree in their chosen specialties under contractual obligations;
implementation of high-level educational activities for individuals to obtain specialized secondary, professional (vocational-technical) and/or professional higher education;
conducting scientific activities by conducting scientific research and ensuring the creative activity of participants in the educational process, training highly qualified scientific personnel and using the obtained results in the educational process;
implementation of adult education as a component of lifelong education (postgraduate education, professional training of employees, retraining and/or professional development courses, continuous professional development, any other components provided by legislation and proposed by the Academy), aimed at realizing the right of every adult for continuous training taking into account her personal needs, priorities of social development and the needs of the economy;
selection, training and certification of highly qualified scientific and scientific-pedagogical personnel;
training entrants and career guidance work with them, informing entrants and students about the situation and trends in the labor market;
professional development and retraining of personnel, educational and professional consulting activities;
financial and economic, production and commercial, publishing, cultural and artistic, sports and health activities;
participation in ensuring the social and economic development of the state through the formation of human capital;
ensuring an organic combination of educational, scientific and innovative activities in the educational process;
creating the necessary conditions for the participants of the educational process to realize their abilities and talents;
preservation and

multiplication of moral, cultural, scientific values and achievements of society;

spreading knowledge among the population, raising the educational and cultural level of citizens;
establishment of international relations and implementation of international activities in the field of education, science, sports, art and culture. International activities related to the implementation of joint educational, scientific and other programs and projects with foreign partners, primarily in the direction of European integration;
personality formation by means of patriotic, legal, ecological education, confirmation of moral values, social activity, civic position and responsibility, healthy lifestyle, ability to think freely and self-organize in modern conditions in the participants of the educational and scientific process;
other types of economic activity are not prohibited by law.

1.13. The Academy can conduct educational activities jointly with Ukrainian and foreign educational institutions according to agreed educational programs.

 

1.14. The educational process and administration at the Academy are conducted in the state language. The use of languages at the Academy is determined by the laws of Ukraine “On ensuring the functioning of the Ukrainian language as the state language” and “On education”. The Academy has the right to decide on teaching one, several or all disciplines, carrying out individual tasks and conducting control measures in English, provided that all students studying the relevant disciplines speak English. If there is a written request from one or more students, the Academy provides a translation into the state language.

CONCEPT OF EDUCATIONAL ACTIVITY OF THE ACADEMY

2.1. The concept of educational activity is based on:

– formation of the content of education and the content of training, the opening of new directions, specialties, specializations in accordance with the needs of the labor market;

– formation of educational programs exclusively on the basis of competence;

– ensuring the integration of educational and scientific activities through increasing the role of research components in educational programs;

– creation of conditions for inseparability of learning processes and research work;

– creation of a new generation of interdisciplinary research educational programs;

– innovative development of education through the shift of emphasis from the classroom to the independent work of students and from the educational to the scientific and methodical work of teachers;

 

– implementation of European standards and principles of ensuring the quality of higher education, taking into account the requirements of the labor market for the competences of specialists;

– ensuring compliance of educational programs with international classifications and standards of higher education;

– introduction of remote technologies into the educational process;

– expansion of the Academy’s participation in international programs of academic mobility of students and scientific and pedagogical workers;

– preparation of educational programs and educational and methodical publications jointly with foreign partners;

– integration with educational institutions of various levels, scientific institutions and enterprises, in particular, through the creation of educational-scientific-production complexes;

– conducting high-level educational activities, which ensures that persons of higher education acquire the appropriate degree in the chosen specialties;

– conducting scientific activities by conducting scientific research and ensuring the creative activity of participants in the educational program, training highly qualified scientific personnel and using the obtained results in the educational process;

– participation in ensuring the social and economic development of the state through the formation of labor potential;

– personality formation through patriotic, legal, ecological education, confirmation of moral values, civic position and responsibility, social activity, healthy way, free thinking and self-organization in modern conditions in the participants of the educational process;

– ensuring the combination of educational, scientific and innovative activities in the educational process;

 

– creating the necessary conditions for the participants of the educational process to realize their abilities and talents;

– preservation and multiplication of moral, cultural, scientific values and achievements of society;

– dissemination of knowledge among students of higher education, increase in educational and cultural diversity of citizens.

2.2. The means of implementing educational activities include:

formation of a high-quality contingent of students;
introduction into the work practice of the departments of progressive technologies of learning and control of students’ knowledge using modern software and the Internet;
revision of educational plans and programs of educational courses in order to ensure the consistency of teaching and eliminate duplication of material when students study individual disciplines;
preparation by departments of the necessary methodical support for students’ independent work;
compliance of the content of education with the requirements of the labor market;
formation of the nomenclature of directions and specialties in accordance with changes in market conditions;
updating the content of education and organization of the educational process in accordance with democratic values, modern scientific and technical achievements;
updating the forms of organization of the educational process, its computerization;

 

  • introduction of distance learning;
    creation of electronic textbooks;
    use of modern teaching aids;
    provision of ample opportunities for mastering foreign languages through a system of electives and special courses;
    development of a network of separate structural divisions of the Academy with the aim of expanding opportunities for the formation of a contingent of students.

    2.3. The main tasks of education of student youth are:

    ensuring cultural and spiritual development of the individual, education in the spirit of patriotism and respect for the Constitution of Ukraine;
    education of students in the spirit of a democratic outlook, respect for traditions, culture, religion and languages of the peoples of the world;
    the formation of a modern worldview in young people, the development of abilities and skills of independent scientific knowledge, self-education and self-realization of the individual;
    stimulating young people’s desire for a healthy lifestyle;
    formation of young people’s needs and ability to live in a civil society, spirituality and physical perfection, moral, artistic-aesthetic, labor, ecological culture;
    formation of national positions, ideas, views and beliefs based on the values of national and world culture;
    instilling the ability for independent activity aimed at the prosperity of Ukraine;
    promoting the development of a high linguistic culture of students, fostering respect for the state language and the languages of national minorities of Ukraine, tolerance in the attitude towards speakers of different languages and cultures.

    2.4. Training of specialists with higher education is carried out by the Academy according to the relevant educational-professional, educational-scientific, scientific programs at the following levels of higher education:

    initial level (short cycle) of higher education;
    first (bachelor’s) level;
    second (master’s) level;
    the third (educational-scientific / educational-creative) level;
    scientific level.

    2.5. Obtaining a higher education at the Academy at each level of higher education requires a person to successfully complete the corresponding educational (educational-professional or educational-scientific) or scientific program, which is the basis for awarding the corresponding degree of higher education:

    junior bachelor (junior specialist);
    bachelor;
    master’s degree;
    doctor of philosophy;
    PHD.

    2.6. The training of specialists with professional higher education is carried out by the Academy (its structural subdivisions and/or separate structural subdivisions) according to the educational and professional degree – professional junior bachelor.

    2.7. The main forms of obtaining higher education at the Academy are:

    institutional (full-time (day, evening), extramural, distance, online);
    dual

    Individuals have the right to obtain higher education in different forms or to combine them.

    2.8. The Academy may use other forms of obtaining higher education and combine forms of obtaining higher education in accordance with the provisions on the organization of the educational process at the Odesa International Academy, as well as establish requirements for combining forms of obtaining higher education.

    2.9. The educational process at the Academy is carried out in the following forms:

  • educational classes;
    independent work;
    practical training;
    control measures.

    2.10. The main types of training classes at the Academy are:

    1) lecture;

    2) laboratory, practical, seminar, individual class;

    3) consultation.

    2.11. The Academy has the right to establish other forms of the educational process and types of training classes.

    2.12. In order to create conditions for international academic mobility, the Academy has the right to decide on the teaching of one or more disciplines in English and/or other foreign languages, while ensuring that students of higher education acquire knowledge of the relevant discipline in the state language. At the request of those seeking higher education, the Academy creates an opportunity for them to study the language of the indigenous people, the national minority of Ukraine as a separate discipline.

    2.13. The practical training of persons studying at the Academy is carried out through their internship at enterprises, institutions and organizations in accordance with the agreements concluded by the Academy.

    Managers of enterprises, institutions and organizations are obliged to ensure the creation of appropriate conditions for practical training at work, compliance with the rules and norms of labor protection, safety equipment and industrial sanitation in accordance with the legislation. Apprenticeships for higher education students are carried out in accordance with legislation.

    2.14. Ensuring the quality of educational activities and the quality of higher education (internal quality assurance system) at the Academy is carried out by implementing the following procedures and measures:

    determination of the principles and procedures for ensuring the quality of higher education;
    implementation of monitoring and periodic review of educational programs;
    annual assessment of higher education applicants, academic and pedagogical staff of the Academy and regular publication of the results of such assessments on the official website of the Academy, on information stands and in any other way;
    ensuring professional development of pedagogical, scientific and scientific-pedagogical workers;
    ensuring the availability of the necessary resources for the organization of the educational process, including independent work of students, for each educational program;
    ensuring the availability of information systems for effective management of the educational process;
    ensuring publicity of information about educational programs, degrees of higher education and qualifications;
    ensuring compliance with academic integrity by employees of the Academy and students of higher education, including the creation and ensuring the functioning of an effective system for the prevention and detection of academic plagiarism;
    other procedures and measures.

    2.15. The Academy is obliged to take measures (including through the introduction of relevant new technologies) to prevent and detect plagiarism in the scientific works of scientific, scientific-pedagogical, pedagogical, other employees and students of higher education and to bring them to disciplinary responsibility, provided for by the norms of legislation, corresponding regulations and the Statute of the Academy.

    Rights and obligations of the founder of the academy

    3.1. Founder of Odessa International Academy:

– approves the Statute of the Odessa International Academy and makes changes or additions to it;

– concludes a contract with the head – rector of the Odessa International Academy;

– organizes the licensing of the Odesa International Academy;

– concludes a contract with the rector of the Odesa International Academy, in accordance with the Law of Ukraine “On Higher Education” and the provisions of this Statute;

– supervises the financial and economic activities of the Odessa International Academy;

– decides on admission to the co-founders of the Odesa International Academy;

– decides on the reorganization or liquidation of the Odesa International Academy;

– exercises other powers provided for by the current legislation.

3.2. The founder of the Odesa International Academy is obliged to:

– to support the Odesa International Academy in its activities in every possible way;

 

– to observe confidentiality in matters related to the activities of the Odessa International Academy.

3.3. The founder of the Odessa International Academy has the right to:

– to participate in the management of the affairs of the Odesa International Academy in the manner determined by this Statute;

– to receive information about the activities of the Odessa International Academy, including getting acquainted with the data of accounting, reporting and other documentation in the manner determined by this Statute and internal documents;

– as a matter of priority, to participate in the implementation of the programs of the Odessa International Academy.

3.4. The founder exercises his rights regarding the management of the Odessa International Academy directly or through a person authorized by him;

3.5. The founder or a person authorized by him can delegate his powers to the rector of the Odessa International Academy.

STRUCTURE AND AUTHORITIES OF THE ACADEMY

4.1. The structure of the Academy is determined by the rector of the Academy, in accordance with the Law of Ukraine “On Higher Education” and this Statute.

4.2. The Academy with its structural subdivisions (educational and scientific institutes, faculties, departments, research institutes, centers, library, sports complex, student campus, departments, economic subdivisions, archives, and other structural subdivisions that ensure the life of the Academy is a single complex, in which, in accordance with the legislation of Ukraine and this Statute, separate structural subdivisions (branches) may also operate.

4.3. Structural subdivisions of the Academy are created in accordance with the current legislation of Ukraine and function in accordance with separate provisions.

4.4. In order to improve the activities of the Academy, to exchange work experience with other educational institutions and institutions, in particular foreign ones, associations and other associations may be created, which are not prohibited by the current legislation of Ukraine.

4.5. The activity of the Academy is based on the following principles:

– autonomy and self-government;

– demarcation of rights, powers and responsibilities of the founder (founders), management bodies of the Academy and its structural subdivisions;

– a combination of collegial and single-principle principles;

– independence from political parties, public and religious organizations.

 

4.6. The Academy has equal rights with other institutions of higher education, which constitute the content of its autonomy and self-governance, in particular, it has the right to:

– develop and implement educational (scientific) programs within the licensed specialty (for both Ukrainian and foreign citizens);

– prepare Ukrainian and foreign citizens for admission to higher education institutions;

– to conduct career orientation work among students and school graduates, independently determining the methods and forms of its implementation;

– independently determine the forms of education and forms of organization of the educational process;

– choose the types of bachelor’s and master’s training programs provided by the International Standard Classification of Education;

– hire pedagogical, scientific, scientific-pedagogical and other workers;

– form and approve own staff list, in accordance with legislation;

– to make a final decision on the recognition, among other things, of establishing the equivalence of bachelor’s, master’s, doctor of philosophy, doctor of science and scientific titles of associate professor, professor obtained in foreign institutions of higher education during enrollment for studies and/or for the position of a scientific or scientific-pedagogical employee ;

– to introduce rating evaluation of educational, research and innovative achievements of participants in the educational process;

– to provide additional educational and other services in accordance with the legislation;

– independently develop and implement own programs of educational, scientific, scientific-technical and innovative activities;

– independently introduce specializations, determine their content and programs of educational disciplines;

– to award degrees of higher education to those who, in accordance with the legislation, have successfully passed the certification procedure after completing their studies at the appropriate level of higher education;

– to make the final decision on the awarding of scientific degrees by accredited specialized academic councils;

– make the final decision on the awarding of academic degrees by accredited specialized academic councils;

– to establish institutions of general secondary education in agreement with local self-government bodies;

– to form, reorganize and liquidate its structural subdivisions;

– to carry out publishing activities, in particular to publish textbooks, training aids and scientific works, as well as to develop one’s own printing base;

– to carry out joint activities with educational institutions, scientific institutions and other legal entities on the basis of relevant contracts;

– to place their educational, scientific-research and educational-scientific-production units at enterprises, institutions and organizations;

– participate in the work of international organizations;

 

– to introduce own symbols and attributes;

– establish own forms of moral and material encouragement of participants in the educational process;

– take the initiative to apply to the governing bodies in the field of higher education about introducing changes to current or developing new normative legal acts in the field of higher education, as well as participate in work on projects;

– to conduct financial and economic and other activities in accordance with the legislation and the Statute of the Academy;

– dispose of own revenues, in particular from the provision of paid services;

– open current and deposit accounts in banks;

– to form innovative structures of various types (science and technology parks, business incubators, small enterprises, etc.) on the basis of combining the interests of high-tech companies, science, education, business and the state in order to implement and implement innovative projects;

– to establish standards for the number of persons who are studying for one position of a scientific-pedagogical and scientific worker;

– independently determine the articles and amounts of expenses of own income;

– to exercise other rights that do not contradict the legislation.

4.7. Implementing the principle of autonomy and self-governance, the Academy also has the right to:

– to make independent decisions and take appropriate actions within the scope of their competence in educational, research and production and economic activities;

– financing from funds received from legal entities and individuals, charitable and sponsorship contributions;

– independent use of the property of the Academy, in particular buildings, structures, inventory and other property for various purposes, among other things, for carrying out economic activities, providing it for rent, alienating it;

– independent use of funds and other securities owned by the Academy;

– receiving all types of loans, temporary and financial assistance, loans, contributions and voluntary donations from banks, enterprises, as well as private individuals;

– implementation of capital construction, reconstruction, capital and ongoing repair of fixed assets independently or on contract terms or in an economic way, as well as to rent or acquire land plots for the construction and/or maintenance of buildings and structures;

 

– independent and/or joint-stock financing of the construction of educational, scientific, residential (in particular, residential buildings, dormitories) and cultural and household objects;

– carrying out various types of work on the basis of direct contractual obligations, agreements and contracts with both domestic and foreign state, public and other enterprises, organizations, as well as private individuals;

– directing fundamental, applied research and development to the creation and implementation of new competitive equipment, technologies, materials and products;

– making direct connections with foreign partners;

– independent determination of the system, forms and volume of remuneration of employees, the procedure for the use of funds, as well as independent determination of the structure and staff of scientific and pedagogical personnel and all other categories of employees;

– independent determination of the terms, forms and amounts of tuition fees and the provision of other services;

– independent clarification of issues of internship, professional development, exchange of experience with the implementation of official business trips both in Ukraine and abroad in the established order;

– creation of permanent and temporary creative teams to realize their goals and tasks;

– attraction of material resources as an organizational or prize fund for general-academic, all-Ukrainian, international events, which are held within the framework of the Academy’s development program (educational, scientific, cultural-mass, educational, creative, sports, etc.);

– designation and use of general academic paraphernalia and signs with the symbols of a higher education institution both in the organization of the educational process, scientific activity, and to encourage participants in the educational process;

– exercise of other powers regulated by the current legislation of Ukraine and the Statute of the Academy.

4.8. The Academy is obliged to:

– comply with the requirements of the legislation of Ukraine;

– to take measures, including through the introduction of relevant latest technologies, to prevent and detect academic plagiarism in the scientific works of scientific, scientific-pedagogical, pedagogical, other workers and students of higher education and bring them to disciplinary responsibility;

– have an internal system for ensuring the quality of higher education, including an approved policy for ensuring that participants in the educational process comply with academic integrity (code of academic integrity);

– to create the necessary conditions for obtaining higher education for persons with special educational needs;

– to ensure state standards of education and scientific and technical products;

– when determining the activity strategy, take into account the requirements of educational and professional standards;

– ensure payment of labor and payment of taxes and other deductions in accordance with current legislation;

– ensure compliance with legislation on life safety;

– to carry out accounting, operational accounting and statistical reporting in accordance with current legislation;

– publish on the official website, on information stands and in any other way information about the exercise of one’s rights and the fulfillment of obligations;

– to carry out educational activities based on the principles of student-centered learning;

– to issue own documents on higher education according to a special model determined by the academic council of the Academy;

– create safe conditions for conducting educational activities;

– keep and rationally use the property and funds of the Academy;

 

– to promote the activities of the public self-government bodies of the Academy, the student self-government of the Academy and students of higher education, etc.;

– by decision of the General Assembly of the Academy’s labor team, scientific and pedagogical workers and other employees, persons studying at the Academy may be granted additional rights (benefits) in accordance with the concluded Collective Agreement between the Academy’s management and the trade union organization – in the event of its creation.

4.9. Labor relations with managers, scientific, creative and other employees of the Academy are established on the basis of fixed-term (contracts) and open-ended labor contracts concluded in accordance with the current legislation of Ukraine.

4.10. The Academy has the right to issue documents on higher education from accredited educational programs based on approved samples. The Academy has the right to also issue certificates of completion of relevant courses, seminars, etc.

RIGHTS AND OBLIGATIONS OF PARTICIPANTS IN THE EDUCATIONAL PROCESS OF THE ACADEMY

5.1. Participants in the educational process at the Academy are:

1) scientific, scientific-pedagogical and pedagogical workers;

2) students of higher education and other persons studying at the Academy;

3) practitioners who are involved in the educational process in educational and professional programs;

4) other employees of the Academy (administrative and economic staff, auxiliary technical staff and junior service staff).

5.2. Scientific-pedagogical, pedagogical and scientific workers of the Academy.

5.2.1. Scientific and pedagogical workers are persons who, according to their main place of work in the Academy, conduct educational, methodical, scientific (scientific and technical) and organizational activities.

5.2.2. Pedagogical workers are persons whose main place of work in the Academy is conducting educational, methodical and organizational activities.

5.2.3. Scientific workers are persons who, at their main place of work and in accordance with the employment contract (contract), professionally carry out scientific, scientific-technical or scientific-organizational activities and have the appropriate qualifications, regardless of the presence of a scientific degree or academic title.

5.2.4. Medical, pharmaceutical, and other employees of the Academy’s clinical bases, academic clinics, and academic hospitals are persons who, by their main place of work, are engaged in medical, pharmaceutical, or veterinary activities, and may also participate in the educational process.

5.3. The scientific, scientific-technical and innovative activity of scientific-pedagogical employees of the Academy is regulated by the legislation on scientific and scientific-technical and innovative activity.

5.4. The complete list of positions of scientific, pedagogical and pedagogical workers of the Academy is established on the basis of the list of positions determined by the Cabinet of Ministers of Ukraine. The list of positions of scientific workers of the University is determined in accordance with the Law of Ukraine “On scientific and scientific and technical activities”.

5.5. The positions of scientific and pedagogical workers can be held by persons who have a scientific degree or an academic title, as well as persons who have a master’s degree.

5.6. The positions of scientific and pedagogical workers are accepted by persons whose physical and mental condition allows them to carry out scientific and pedagogical activities and who have qualifications that meet the established legislation, in particular the professional standard (if available), qualification requirements for the corresponding positions of scientific and pedagogical workers. Additional requirements for persons who can occupy the positions of scientific and pedagogical workers are established in accordance with the legislation of Ukraine by job instructions for scientific and pedagogical workers approved by the rector of the Academy.

 

5.7. When filling vacant positions of scientific and pedagogical workers – heads (heads) of departments, professors, associate professors, senior lecturers, lecturers, the conclusion of an employment contract (contract) is preceded by a competitive selection, the procedure for which is approved by the Academic Council of the Academy.

The Academy may enter into short-term employment contracts with foreign citizens in accordance with the legislation.

5.8. In some cases, in the case of the impossibility of providing the educational process with available full-time employees, vacant positions of scientific and pedagogical workers may be replaced under an employment contract until the competitive replacement of these positions is held in the current academic year.

5.9. A person in the Academy cannot simultaneously hold two or more positions involving the performance of administrative and management functions.

5.10. The working time of scientific and pedagogical workers is 36 hours per week (reduced working time).

The working time of a scientific and pedagogical employee includes the time he performs educational, methodical, scientific, organizational work and other work duties. The working time of a scientific worker includes the time he performs scientific, research, advisory, expert, organizational work and other work duties. The working time of a pedagogical worker includes the time he performs educational, methodical, organizational work and other work duties.

The norms of time for educational, methodical, scientific, and organizational work are determined by the Academy.

The maximum educational load for one rate of a scientific and pedagogical worker cannot exceed 600 hours per academic year.

5.11. The recommended list of types of educational, methodical, scientific and organizational work for scientific and pedagogical, scientific and pedagogical workers is established by the central executive body in the field of education and science.

5.12. The types of educational work of pedagogical and scientific-pedagogical workers in accordance with their positions are established by the Academy in agreement with the trade union organization – upon its creation.

 

5.13. Involvement of scientific-pedagogical, scientific and pedagogical workers in work that is not provided for in the employment contract (contract) can be carried out only with their consent or in cases provided for by the legislation of Ukraine.

5.14. The rights of scientific and pedagogical, scientific and pedagogical workers.

5.14.1. Scientific and pedagogical, scientific and pedagogical workers of the Academy have the right to:

on academic freedom, which is realized in the interests of the individual, society and humanity in general;
on academic mobility for carrying out professional activities;
participate in the management of the Academy, including electing and being elected to the highest body of public self-government, the academic council of the Academy or its structural division;
on the development and implementation of author’s educational programs, projects, educational methods and technologies, methods and tools, primarily competence training methods;
to protect professional honor and dignity;
choose teaching methods and tools that ensure high quality of the educational process;
to ensure appropriate working conditions, increase one’s professional level, organization of recreation and life established by legislation, normative acts of the Academy, terms of the individual contract (employment contract) and the Collective Agreement;
free use of library, information resources, services of educational, scientific, sports, cultural and educational divisions of the Academy;
to protect intellectual property rights;
to celebrate success in one’s professional activity;
for a fair and objective evaluation of one’s professional activity;
for individual educational (scientific, creative, artistic and other) activities outside the Academy;
for advanced training and internship at least once every five years;
participate in citizen associations;
for a creative leave for a period of up to one year no more than once every 10 years with enrollment in work experience;
for extended paid leave;
for social and pension insurance in accordance with the procedure established by law.

 

5.14.2. Scientific-pedagogical, scientific and pedagogical employees of the Academy also have other rights provided for by legislation and this Charter.

5.15. Responsibilities of scientific and pedagogical, scientific and pedagogical workers.

5.15.1. Scientific and pedagogical, scientific and pedagogical workers of the Academy are obliged to:

to provide teaching at a high scientific-theoretical and methodical level of educational disciplines of the relevant educational program by specialty, to conduct scientific activities (for scientific and pedagogical workers), to fulfill the standards of educational and scientific activities in the Academy, to conduct scientific activities;
to carry out the educational program in order to achieve the learning outcomes provided for by the higher education students;
to increase the professional level, pedagogical skill, scientific qualification (for scientific and pedagogical workers);
to adhere to the norms of pedagogical ethics and morality, to respect the dignity of persons studying at the Academy, to instill in them love for Ukraine, to educate them in the spirit of Ukrainian patriotism and respect for the Constitution of Ukraine and state symbols of Ukraine;
respect the dignity, rights, freedoms and legitimate interests of all participants in the educational process;
to observe academic integrity in the educational process and scientific (creative) activity and ensure its observance by higher education seekers;
to develop independence, initiative, and creative abilities in persons studying at the Academy;
to contribute to the development of the abilities of those seeking education, the formation of healthy lifestyle skills, to take care of their physical and mental health;
by instruction and personal example, establish respect for public morality and public values, in particular truth, justice, patriotism, humanism, tolerance, hard work;
to make students aware of the need to comply with the Constitution and laws of Ukraine, to protect the sovereignty and territorial integrity of Ukraine;
to instill in students of education respect for the state language and state symbols of Ukraine, national, historical, cultural values of Ukraine, a careful attitude to the historical and cultural heritage of Ukraine and the natural environment;
to form in students of education a desire for mutual understanding, peace, and harmony between all peoples, ethnic, national, religious groups;
to protect students during the educational process from any form of physical and mental violence, humiliation of honor and dignity, discrimination on any grounds, propaganda and agitation that harm the health of the student, to prevent their use by them and other persons on the territory educational institutions for alcoholic beverages, narcotic drugs, other harmful habits;
to comply with the requirements of regulatory and legal acts, the Statute of the Academy, the Code of Ethics of the Academy, the Collective Agreement, other internal acts of the Academy, job instructions, contract conditions.

5.16. Scientific and pedagogical, scientific, pedagogical and other employees of the Academy are guaranteed:

1) creation of proper working conditions, professional development, organization of life, recreation and medical care, including for teachers with disabilities.

2) payment of compensation in case of job loss in accordance with legislation.

5.17. Scientific-pedagogical, scientific and pedagogical workers of the Academy receive additional payments for the scientific degree of Doctor of Philosophy and Doctor of Science in the amounts of 15 and 25 percent of the official salary, respectively, as well as for the academic title of associate professor and senior researcher – 25 percent of the official salary, professor – 33 percent of the official salary . The Academy can establish a larger amount of additional payments at the expense of its own income.

The rector of the Academy, in accordance with the legislation of Ukraine, this Statute and the Collective Agreement, determines the procedure, sets the amounts of extra payments, allowances, bonuses, financial assistance and incentives for pedagogical, scientific-pedagogical, scientific and other employees of the Academy.

5.18. The main positions of scientific and pedagogical workers of the Academy are:

1) rector;

2) vice-rectors whose activities are directly related to the educational or scientific process;

3) the director (head) of the institute, his deputies, whose activities are directly related to the educational or scientific process;

4) the dean of the faculty, his deputies, whose activities are directly related to the educational or scientific process;

5) library director;

6) head (head) of the department;

7) professor;

8) associate professor;

9) senior teacher, teacher, assistant, teacher-intern;

10) library researcher;

11) head of postgraduate studies, doctoral studies.

5.19. The main positions of pedagogical workers of the Academy are:

1) teacher;

2) Methodist.

5.19.1. Pedagogical staff positions can be held by persons with a master’s degree in the relevant specialty.

5.19.2. Pedagogical workers are appointed and dismissed by the rector of the Academy. Pedagogical workers are certified every five years. According to the results of the certification, the suitability of the employees for the position is determined, qualification categories, pedagogic skills are assigned

5.19.3. The procedure for certification of teaching staff is established by the Ministry of Education and Science of Ukraine. The list of qualification categories and pedagogical titles of pedagogical workers, the order of their assignment are determined by the Cabinet of Ministers of Ukraine.

5.20. Persons studying at the Academy are:

1) students of higher education;

2) other persons studying at the Academy.

5.21. Rights of persons studying at the Academy:

5.21.1. Persons studying at the Academy have the right to:

the choice of the form of education during admission to the Academy and during studies in it;
safe and harmless conditions of study, work and life;
quality educational services;
fair and objective assessment of learning outcomes;
freedom of creative, sports, recreational, cultural, educational, scientific and scientific and technical activities, etc.;
respect for human dignity;
labor activity in extracurricular time;
additional paid leave in connection with studies at the main place of work, reduced working hours and other benefits provided by law for persons who combine work with studies;
free use of libraries, information funds, educational, scientific and sports bases of the Academy;
free provision of information for education in accessible formats using technologies that take into account limitations of life activities caused by health conditions (for persons with special educational needs);

 

  • use of the Academy’s industrial, cultural and educational, household, health facilities;
    provision of a dormitory and round-the-clock access to it for the duration of studies in accordance with the procedure established by law;
    participation in research, research and design works, conferences, symposia, exhibitions, competitions, presentation of one’s works for publication;
    participation in educational, scientific, scientific-research, sports, artistic, social activities held in Ukraine and abroad, in accordance with the procedure established by law;
    participation in the discussion and resolution of issues of improvement of the educational process, research work, awarding of scholarships, organization of leisure time, life, health improvement;
    making proposals regarding the terms and amount of tuition fees;
    participation in public associations;
    participation in the activities of public self-government bodies of the Academy, institutes, faculties, branches, academic council of the Academy, student self-government bodies;
    the choice of academic disciplines within the limits provided by the relevant educational program and curriculum, in the amount of at least 25 percent of the total number of ECTS credits provided for this level of higher education. At the same time, applicants of a certain level of higher education have the right to choose academic disciplines offered for other levels of higher education, in agreement with the head of the relevant faculty or unit;
    studying at the same time in several educational programs, as well as in several institutions of higher education;
    lifelong learning, academic mobility, including international mobility;
    receiving social assistance in cases established by law;
    enrollment in the insurance period in accordance with the Law of Ukraine “On Mandatory State Pension Insurance” of periods of full-time study at the Academy, graduate school, doctoral school, etc., subject to voluntary payment of insurance contributions;
    an academic leave or a break in studies with the preservation of individual rights of a student of higher education, as well as for the renewal of studies in accordance with the procedure established by the Ministry of Education and Science of Ukraine;
    participation in the formation of an individual study plan;
    moral and/or material encouragement for success in studies, research and public work, for artistic and sports achievements, etc.;
    protection during the educational process from humiliation of honor and dignity, any forms of violence and exploitation, discrimination on any grounds, propaganda and agitation that harm the health of the student of education;
    free internship at enterprises, institutions, institutions and organizations, as well as for payment of labor during the performance of production functions in accordance with the law;
    vacation leave lasting at least eight calendar weeks per academic year;
    contesting the actions of the Academy’s management bodies and their officials, pedagogical and scientific-pedagogical employees;
    special educational and rehabilitation support and free access to the infrastructure of the Academy in accordance with medical and social indications in the presence of limitations of life activities caused by the state of health;
    other necessary conditions for obtaining an education, including for persons with special educational needs and from socially vulnerable strata of the population.

    5.22. Duties of persons studying at the Academy.

    5.22.1. Persons studying at the Academy are obliged to:

    1) comply with the requirements of the legislation of Ukraine, this Statute, the Rules of Internal Procedure of the Academy and the Rules of Internal Procedure in the Academy’s student dormitories, as well as the terms of the agreement on the provision of educational services;

    2) comply with the requirements for labor protection, safety technology, industrial sanitation, and fire safety provided for by the relevant rules and instructions;

    3) fulfill the requirements of the educational (scientific) program (individual curriculum (if available)), observing academic integrity, and achieve the study results determined for the corresponding level of higher education;

    4) respect the dignity, rights, freedoms and legitimate interests of all participants in the educational process, adhere to ethical standards.

    5.23. Administrative and economic staff, support and technical staff and junior service staff.

    5.23.1. Other employees of the Academy are entitled to:

    1) safe and harmless working and living conditions;

    2) additional paid vacation, reduced working hours and other benefits provided for by the legislation of Ukraine and the Collective Agreement;

    3) use of the Academy’s production, cultural and educational, household, health facilities;

    4) benefits and provision of appropriate working conditions that take into account limitations of life activities caused by the state of health (for persons with special needs) in accordance with the legislation of Ukraine and the Collective Agreement;

    5) participation in public associations;

    6) moral and/or material incentives for success in work, the order of which is established by the Collective Agreement;

    7) protection against all forms of exploitation, physical and mental violence.

    5.23.2. Other employees of the Academy are obliged to:

    1) security

    to hear the proper quality of performed works and services;

    2) comply with the requirements of the legislation of Ukraine, this Statute and the Rules of Internal Procedure of the Academy, job instructions;

    3) to comply with the requirements for labor protection, safety technology, industrial sanitation, and fire safety provided by the relevant rules and instructions.

    5.24. Participants in the educational process of the Academy are personally responsible for the conscientious performance of their duties stipulated by the labor legislation, the Collective Agreement, this Statute, the Rules of Internal Procedure of the Academy, the terms of the contract (employment contract), the job instructions of the Academy employees.

    governing bodies of the ACADEMY and their powers

    6.1. The central body of executive power in the field of education and science:

    6.1.1. monitors compliance with the requirements of higher education standards;

    6.1.2. issues educational activity licenses on the basis of a positive expert opinion of the National Agency for Quality Assurance of Higher Education, as well as reissues and cancels them.

    6.2. The National Agency for Quality Assurance of Higher Education carries out accreditation of educational programs that train students of higher education.

    6.3. The authority of the Founders of the Academy is exercised through the General Meeting of the Founders, which consists of the Founders or their authorized representatives. The General Meeting of Founders independently determines the regulations of its work.

    6.4. General Meeting of Founders:

    6.4.1. approve the conclusion by the rector of the Academy of property contracts, as well as lease contracts for buildings, structures, educational and scientific equipment and other property of the Academy for the activities of any third-party state, public and commercial organizations;

    6.4.2. at the request of the academic council, approve the Academy’s annual estimate, changes and additions to it;

    6.4.3. decide on the reorganization or liquidation of the Academy;

    6.4.4. exercise other powers of the Founder provided for by law.

    6.5. The General Assembly of the Founders can delegate its separate powers to the rector or the higher collegial body of public self-government of the Academy.

    6.6. General Meetings of Founders are held as necessary and are valid if they are attended by Founders or their representatives, who together own 65% of the authorized capital of the Academy.

    6.7. Direct management of the activities of the Academy within his competence and in accordance with this Statute is carried out by the rector, who bears full responsibility to the Founders for the results of the Academy’s work. His rights, duties and responsibilities are determined by the legislation of Ukraine and this Charter.

    6.8. The rector of the Academy is appointed to the position by the Founder under the terms of the contract for a period of five years based on the results of the elections in accordance with the Law of Ukraine “On Higher Education”, this Statute and internal documents of the Academy.

    6.9. A candidate for the position of rector of the Academy must speak the state language, have an academic title and a scientific degree, and work experience as a scientific and pedagogical employee. A candidate for the position of rector of the Academy must be a citizen of Ukraine.

    One and the same person cannot be rector of the Academy for more than two terms.

    6.10. A person who:

    1) recognized as incompetent or whose legal capacity is limited by a court decision;

    2) has a criminal record for committing a crime, if such a criminal record has not been expunged or not removed in accordance with the procedure established by law;

    3) in accordance with the court verdict, is deprived of the right to hold relevant positions;

    4) was found guilty of committing a corruption offense by a court decision – within a year from the date of entry into force of the relevant court decision;

    5) was subject to administrative penalty for a corruption offense – within a year from the date of entry into force of the relevant court decision.

    6.11. The founders are obliged to announce a competition for the position of rector of the Academy. Until the rector of the Academy is elected, the Founders shall appoint an acting rector of the Academy.

    6.12. The Rector of the Academy may be dismissed from his position by the Founders on the grounds determined by the legislation of Ukraine, for violation of this Statute and the terms of the contract.

    6.13. The rector is the representative of the Academy in relations with state bodies, local self-government bodies, legal entities and individuals, acts without a power of attorney within the limits of the powers provided for by legislation and this Statute.

    6.14. Rector of the Academy within the limits of the powers granted to him (in the part that does not belong to the exclusive competence of the General Meeting of the Founders of the Academy):

    1) organizes the activities of the Academy;

    2) resolves issues of financial and economic activity of the Academy, approves its structure and staff list;

    3) issues orders and directives, gives mandates that are mandatory for all participants of the educational process and structural divisions of the Academy;

    4) is responsible for the results of the Academy’s activities before the Founders or a body (person) authorized by them;

    5) is a manager of property and funds;

    6) provides

    implementation of the financial plan (estimate), concludes contracts;

    7) appoints and dismisses employees, concludes contracts with employees in cases provided for by the legislation of Ukraine;

    8) ensures labor protection, compliance with law and order;

    9) determines the functional duties of Academy employees,

    10) forms a contingent of persons studying at the Academy;

    11) withdraws from the Academy, reinstates higher education students to study at it on the grounds established by the Law of Ukraine “On Higher Education”, transfers higher education students, grants them academic leaves, leaves them for re-education, resolves the issue of re-education, etc.;

    12) ensures the organization and implementation of control over the implementation of educational plans and programs of educational disciplines, plans of scientific research works and economic works;

    13) monitors compliance by all units of the Academy with staffing and financial discipline;

    14) supervises the quality of the work of pedagogical, scientific-pedagogical, scientific and other employees;

    15) ensures the creation of conditions for effective and open public control over the activities of the Academy;

    16) contributes to the creation of conditions for the activities of student self-government bodies, organizations of trade unions of Academy employees and students, public organizations operating in the Academy;

    17) contributes to the formation of a healthy lifestyle among students of higher education, strengthening the sports and recreation base of the Academy, creates appropriate conditions for mass sports;

    18) jointly with the elected bodies of the Primary trade union organization of the Academy and the Primary trade union organization of students and graduate students of the Academy, submits for approval to the higher collegial body of public self-government of the Academy the Rules of Internal Procedure of the Academy and the Collective Agreement, and after approval signs them;

    19) determines the duties of vice-rectors;

    20) by order puts into effect the decision of the Academic Council of the Academy;

    21) determines additional forms of payment and stimulation of the work of employees, scholarships for persons studying at the Academy, within the framework of funds that are formed at the Academy as a result of the Academy’s activities;

    22) approves annual plans for academic publications of educational, methodical, research and other literature, which corresponds to the main tasks of the Academy;

    23) concludes with organizations, enterprises, institutions regardless of the form of ownership, public organizations, as well as with citizens of Ukraine, foreigners and stateless persons, agreements on the training of specialists in the academy, agreements on cooperation, memoranda, etc.;

    24) ensures the organization and holding of all-Ukrainian and international conferences, seminars, symposia, etc. at the Academy;

    25) in accordance with agreements, agreements and contracts with other organizations and individuals, resolves the issue of performance of works (provision of services);

    26) supervises the quality of the work of employees, applies to them the incentives provided for by the Rules of the Academy’s internal procedure, brings them to disciplinary responsibility in accordance with the current legislation of Ukraine;

    27) on the basis of the submission of the academic council of the Academy, makes a decision on establishing the amount of compensation for training costs;

    28) on the basis of the submission of the academic council, makes a decision on the transfer of students of higher education from studies at the expense of individuals or legal entities to studies under the state order;

    29) ensures compliance with official and state secrets;

    30) has the right to sign financial documents;

    31) exercises other powers in accordance with the legislation of Ukraine.

    6.15. The rector of the Academy is responsible for the implementation of educational, educational, scientific, scientific-technical and innovative activities in the Academy, for the results of financial and economic activities, the condition and preservation of real and other property of the Academy.

    The rector of the Academy may delegate part of his powers to the vice-rectors and heads of structural units of the Academy. Vice-rectors, in accordance with the division of duties, issue orders that are mandatory for scientific, scientific-pedagogical, pedagogical and other employees, students of higher education of the Academy. Orders of vice-rectors may be revoked by the rector of the Academy if they contradict the legislation of Ukraine, this Statute or harm the interests of the Academy.

    6.16. The Rector of the Academy reports annually to the Founders and the highest collegial body of public self-government of the Academy. The rector is obliged to publish an annual report on his activities on the Academy’s official website.

    6.17. After retirement from the position of rector of the Academy, a person who has worked in this position for at least 10 consecutive years may be appointed as an adviser to the rector of the Academy on public grounds or at the expense of the Academy’s own income in the manner specified by this Statute.

    6.18. During the absence of the rector of the Academy, his powers are performed by one of the vice-rectors in the order of priority specified in the order of the rector of the Academy on the distribution of responsibilities among the leadership of the Academy;

    6.19. The faculty is managed by the dean

    of the faculty, management of the educational and scientific institute – the director (head) of the educational and scientific institute, who are elected by the academic council of the Academy, and are appointed to a position under a contract for a period of 5 years by the rector of the Academy.

    6.20. The head of the faculty (educational and scientific institute) must have a scientific degree and/or an academic (honorary) title, as a rule, according to the profile of the faculty (educational and scientific institute).

    The authority of the head of the faculty (educational and scientific institute), their rights and duties are determined by the provisions of the faculty (educational and scientific institute), which are approved by the Academic Council of the Academy.

    The dean (head) of the faculty, the director (head) of the educational and scientific institute may be dismissed from his position by the rector of the Academy at the request of the academic council of the Academy or the public self-government body of the faculty (institute) on the grounds determined by the labor legislation, for violation of this Statute or the terms of the contract. The proposal to dismiss the head of the faculty (educational and scientific institute) is submitted to the public self-government body of the faculty (educational and scientific institute) by at least half of the votes of the statutory composition of the academic council of the faculty (educational and scientific institute), if the latter has been created, or the academic council of the Academy. The proposal to dismiss the head of the faculty (educational and scientific institute) is accepted by at least two-thirds of the votes of the meeting (conference) of the labor team of the faculty (educational and scientific institute).

    6.21. The dean (head) of the faculty, the director (head) of the educational and scientific institute may delegate part of their powers to their deputies.

    6.22. The dean (head) of the faculty, the director (head) of the educational and scientific institute issue orders regarding the activities of the respective faculty (educational and scientific institute), which are mandatory for all participants in the educational process of the faculty (educational and scientific institute) and can be canceled by the rector Academy, if they contradict the legislation, the statute of the Academy or harm the interests of the Academy.

    6.23. The management of the activities of branches, educational and scientific centers, schools, colleges is carried out by the director, who is elected by the academic council of the Academy and appointed to the position under a contract for a period of up to 5 years by the rector of the Academy.

    6.24. The management of the preparatory department, the department of postgraduate and doctoral studies is carried out by the head, who is appointed to the position under a contract by the rector of the Academy.

    6.25. The election, appointment and dismissal of the head of a branch, educational and scientific center, school or college, preparatory department or department of postgraduate and doctoral studies, which are structural divisions of the Academy, is carried out in accordance with the procedure established by this section of the Statute.

    6.26. Deans of faculties, directors of institutes, directors of branches, educational and scientific centers, schools, colleges, head of the preparatory department, head of the department of postgraduate and doctoral studies manage faculties, institutes, branches, educational and scientific centers, schools, colleges, departments within the limits of their rights and obligations ties established by the relevant normative acts on education, as well as by the provisions of the relevant unit.

    6.27. The rector of the Academy, in which a new faculty (educational and scientific institute) is formed, appoints the acting head of this faculty (educational and scientific institute) for the period until the election of the head of the faculty (educational and scientific institute), but for no more than three months .

    6.28. The department is managed by the head (head) of the department, who cannot hold the position for more than two terms.

    The head of the department must have a scientific degree and/or an academic (honorary) title in accordance with the profile of the department. The head (head) of the department is elected by secret ballot by the academic council of the Academy for a period of five years, taking into account the proposals of the faculty (educational and scientific institute) and the department. The rector of the Academy concludes a contract with the head of the department.

    The head of the department may be dismissed from his position by the rector of the Academy on the grounds specified by law.

    6.29. The head of the department ensures the organization of the educational process, implementation of educational plans and programs of educational disciplines, supervises the quality of teaching of educational disciplines, educational, methodological and scientific activities of teachers.

    6.30. The Academic Council is a collegial governing body of the Academy, which is formed for a period of five years, the composition of which is approved by the order of the rector of the Academy within five working days from the date of termination of the powers of the previous members of the Academic Council of the Academy.

    Regulations on the academic council of the Academy, its composition, functions and work procedure are adopted by the academic council of the Academy and approved by the Founders of the Academy.

    6.31. Academic Council of the Academy:

    determines the strategy and prospective directions of the development of educational, scientific and innovative activities of the Academy;
    develops and submits to the Conference of the Academy’s labor team a draft of a new version of the University’s Statute, as well as a decision to introduce amendments

    others and additions to it;
    approves the financial plan (estimates of income and expenses) and the annual financial report of the Academy;
    determines the system and approves procedures for internal quality assurance of higher education;
    adopts, at the request of the rector of the Academy, decisions on the formation, reorganization and liquidation of structural divisions;
    approves educational programs, training programs and curricula for each level of higher education and specialty;
    makes decisions on the organization of the educational process, determines the terms of study at the appropriate educational levels;
    approves the sample and procedure for producing documents on higher education, including joint and double diplomas (with domestic and/or foreign higher educational institutions-partners), regulations on the procedure and grounds for issuing them to students of higher education;
    approves the main directions of conducting scientific research and innovative activities;
    evaluates the scientific and pedagogical activity of structural subdivisions;
    assigns academic titles of professor, associate professor and senior researcher and submits relevant decisions for approval to the Attestation Board of the Ministry of Education and Science of Ukraine, assigns honorary titles of the Academy in accordance with the established procedure;
    makes, in the established manner, final decisions on the recognition of foreign documents on higher education, scientific degrees and scientific titles during the hiring of pedagogical, scientific, scientific-pedagogical and other employees, as well as during the enrollment of entrants to study;
    elects by secret ballot to the positions of deans, directors of institutes, heads (heads) of departments, professors and associate professors of departments, director of the scientific library, heads of Academy branches;
    has the right to submit a motion to recall the rector of the Academy on the grounds provided for by legislation, the Statute of the Academy, the contract, which is considered by the Conference of the Academy’s labor team;
    determines the criteria for granting scientific and pedagogical staff of the Academy, who are doctors of philosophy (candidates of sciences), permission for scientific supervision of graduate students and grants such permission;
    establishes the peculiarities of the Academy’s management, which contribute to the development and improvement of the quality of its educational activities and competitiveness, the attraction of additional financial resources;
    considers other issues of the Academy’s activity in accordance with the legislation of Ukraine and this Statute.

    6.32. The Academic Council of the Academy is headed by its chairman, who is elected by secret ballot from among the members of the Academic Council of the Academy who have a scientific degree and/or an academic (honorary) title, for the term of the Academic Council of the Academy. The duties of the chairman of the Academic Council of the Academy may also be assigned, in his absence, to the deputy chairman of the Academic Council of the Academy, who is elected by open voting at the first meeting of the newly elected Academic Council of the Academy.

    6.33. The scientific council of the Academy includes:

    6.33.1. By positions:

    1) rector of the Academy;

    2) vice-rectors;

    3) heads of faculties and educational and scientific institutes;

    4) learned secretary;

    5) library director;

    6) chief accountant;

    7) heads of self-governing bodies and elected bodies of primary trade union organizations of Academy employees.

    6.33.2. By decision of the Academic Council of the Academy, it may also include representatives of employers’ organizations. At the same time, at least 75% of the academic council of the academy should be scientific, scientific and pedagogical workers of the academy, and at least 10% should be elected representatives from among the higher education graduates of the Academy.

    6.34. Elections to the members of the academic council begin 30 calendar days before the end of the term of office of the previous members of the academic council of the Academy.

    Elected representatives from among the employees of the Academy are elected by the higher collegial body of the public self-government of the Academy on the basis of the structural subdivisions in which they work, and elected representatives from among the students of higher education are elected by students through direct secret elections.

    6.35. Decisions of the academic council of the Academy are put into effect by decisions of the rector of the Academy;

    6.36. Academic councils of structural subdivisions – faculties, educational and scientific institutes, structural subdivisions (branches) are formed in the Academy, the powers of which are determined by the Academic Council of the Academy in accordance with the regulation on the Academic Council of an educational and scientific institute (faculty) of the Academy. The Academic Council of the Academy may delegate part of its powers to the Academic Councils of structural subdivisions.

    6.37. The academic council of the educational and scientific institute (faculty) of the Academy is a collegial governing body of the educational and scientific institute (faculty) of the Academy. Duties of the chairman of the Academic Council of the educational and scientific institute (faculty) of the Academy may also be assigned, in his absence, to the deputy chairman of the Academic Council of the academic and scientific institute (faculty) of the Academy.

    6.38. The Academic Council of the educational and scientific institute (faculty) of the Academy includes the head of the educational and scientific institute (faculty) and his deputies, heads of departments, heads of self-governing bodies and a representative of the trade union organization of the Academy from the educational

    – of a scientific institute (faculty), the head of the student self-government body of an educational and scientific institute (faculty) of the Academy, as well as, according to a specified quota, elected representatives who represent scientific, scientific and pedagogical workers of an educational and scientific institute (faculty) of the Academy, who are elected from number of professors, associate professors, doctors of philosophy (candidates of sciences), doctors of science, elected representatives who represent the auxiliary and technical staff of the educational and scientific institute (faculty) of the Academy and who work there on a permanent basis, elected representatives of students, graduate students, doctoral students.

    The total quota of scientific and pedagogical workers of the Academy, who are part of the Academic Council of the educational and scientific institute (faculty) of the Academy by positions or are elected to its membership, is set at no less than 75%, the total quota of elected student representatives is at least 10% , the total quota of representatives of graduate students and doctoral students of the departments of the educational and scientific institute (faculty) of the Academy is not less than 2%, the rest of the members are representatives of other employees of the educational and scientific institute (faculty) of the Academy, who are part of the Scientific Council of the educational and scientific institute ( faculty) of the Academy by position or are elected in accordance with the procedure determined by the Regulations on the Academic Council of the structural subdivision of the Academy and / or the Regulations on the Academic Council of the educational and scientific institute (faculty) of the Academy.

    The procedure for changes in the composition of the academic council of the educational and scientific institute (faculty) of the University is regulated by this Statute, as well as the Regulation on the Academic Council of the educational and scientific institute (faculty) of the Academy, which is approved by the Academic Council of the Academy and put into effect by the order of the rector of the Academy, and the Regulations of the Academic Council of the educational and scientific institute (faculty) of the Academy, which is approved by the scientific council of the educational and scientific institute (faculty) of the Academy and is put into effect by the order of the rector of the Academy.

    6.39. Decisions of the Academic Council of the educational and scientific institute (faculty) of the Academy are implemented by issuing orders by the head of the educational and scientific institute (faculty) of the Academy, which are mandatory for all participants in the educational process of the educational and scientific institute (faculty) of the Academy and can be canceled by the rector of the Academy , if they contradict the legislation of Ukraine, the Statute of the Academy, the Regulation on the relevant structural division of the Academy or harm the interests of the Academy.

    6.40. According to the decision of the Founder, a Supervisory Board is formed in the Academy to supervise the management of the Academy’s property, compliance with the purpose of its creation.

    6.41. The Supervisory Board of the Academy contributes to solving promising tasks of its development, attracting financial resources to ensure its activities in the main areas of development and exercising control over their use, effective interaction of the Academy with state bodies and local self-government bodies, the scientific community, socio-political organizations and sub objects of economic activity in the interests of development and improvement of the quality of educational activity and competitiveness of the Academy, carries out public control over its activities, etc.

    6.42. Graduates of higher education and employees of the Academy cannot be members of the Supervisory Board. The Chairman, his deputies and members of the Supervisory Board perform their duties on public grounds.

    The personnel composition of the Supervisory Board is approved by the academic council of the Academy. The term of office of the Supervisory Board is five years.

    6.43. Members of the Supervisory Board of the Academy have the right to:

    1) participate in the work of the higher collegial body of public self-government of the Academy with the right of an advisory vote;

    2) participate in defining the Academy’s development strategy and monitor its implementation;

    3) promote the attraction of additional sources of financing;

    4) analyze and evaluate the activities of the Academy and its head;

    5) monitor the implementation of the estimate and make relevant recommendations and proposals, which are mandatory for consideration by the rector of the Academy;

    6) submit to the founder of the Academy a proposal for the promotion or withdrawal of the rector of the Academy on the grounds specified by law.

    6.44. The Supervisory Board of the Academy has the right to submit to the highest collegial body of public self-government of the Academy a request to recall the rector of the Academy on the grounds provided for by the legislation of Ukraine, this Statute, the contract.

    6.45. The meeting of the Supervisory Board is convened by the chairman with mandatory notification of the members of the Supervisory Board at least two days before the meeting. At least two-thirds of the Supervisory Board must be present at the meeting. Decisions of the Supervisory Board are made by a majority of votes and are made in writing signed by the chairman and secretary of the meeting.

    6.46. To solve current issues of the Academy’s activities, working bodies are formed – rectorate, deanships, admissions commission, administrative council, etc.

    6.47. In order to develop a strategy and directions for the implementation of educational and/or scientific activities of the Academy, the rector of the Academy has the right to form

    on a public basis, advisory (advisory) bodies (employers’ council, investors’ council, business council, student, scientific council, etc.).

    6.48. Working and advisory bodies are created by the decisions of the rector of the Academy and carry out their activities in accordance with this Statute and the provisions on them, which are approved by the academic council of the Academy.

    6.49. The admission committee of the Academy is formed to organize the reception of entrants. The term of office of the admission commission is one year.

    6.50. The dean’s office is a working body appointed to quickly solve the main current issues of the faculty (institute), college.

    The work of the dean’s office is headed by the dean of the faculty (director of the institute), who determines the personnel of the dean’s office. The dean’s office includes: the dean (director), his deputies, heads of departments of the faculty (institute), faculty (institute) professors, heads of other departments of the faculty (institute) and the secretary of the dean’s office.

     

    Bodies of public self-government of the ACADEMY

    7.1. The highest collegial body of public self-government of the Academy is the general meeting (conference) of the Academy’s work team, including elected representatives from among students.

    7.2. The quantitative composition, standards of representation and the procedure for electing delegates to the general meeting (conference) are determined by the Academic Council of the Academy in agreement with the elected bodies of the trade union organization of the Academy and the student self-government bodies of the Academy.

    7.3. The term of office of the higher collegial public self-government body of the Academy is determined by the general meeting (conference) of the University’s labor team and cannot exceed 5 years.

    7.4. All categories of participants in the educational process of the Academy are represented at the general meetings (conferences) of the Academy’s workforce. At least 75 percent of the delegates to the general meeting (conference) of the Academy’s workforce are scientific and pedagogical, scientific and pedagogical workers who work at the Academy on a permanent basis, and at least 15 percent are elected representatives from among students who are elected by students through direct secret elections, and the rest – representatives of administrative and economic staff, auxiliary and technical staff and junior service staff working at the Academy on a permanent basis.

    Representatives of scientific-pedagogical, scientific and pedagogical workers of the Academy are elected by public self-government bodies of educational and scientific institutes, faculties, structural units (branches) from among the employees of this category, including those scientific-pedagogical, scientific and pedagogical workers who work at the Academy on a permanent basis , and scientific, scientific-pedagogical or pedagogical activity in the structural divisions of the Academy is carried out on the basis of hourly payment or on a part-time basis (rector, vice-rectors, academic secretary, head of postgraduate studies, doctoral studies).

    Representatives from among the students of the Academy are elected to the general meeting (conference) of the Academy’s labor team through direct secret elections, the procedure for which is determined by the Regulations on student self-government at the Academy.

    Representatives of the administrative and economic staff, auxiliary and technical staff and junior service personnel of the Academy, who work in it on a permanent basis, are elected by the general meeting (conference) of the administrative and economic staff, auxiliary and technical staff and junior service personnel of the Academy, the procedure for convening and rules of representation which are determined by the Academic Council of the Academy.

    7.5. The general meeting (conference) of the working team of the Academy is convened at least once a year.

    7.6. Decisions of general meetings (conferences) of the working staff of the Academy are adopted by a simple majority of votes with the mandatory presence of 2/3 of its total composition and 3/4 of the number of delegates from scientific and pedagogical workers. The voting procedure during the approval of decisions is determined by the general meeting (conference).

    7.7. General meeting (conference) of the Academy’s staff:

    1) approves the Statute and amendments thereto upon submission of the Academic Council of the Academy;

    2) listens to the rector’s report every year and evaluates his activities;

    3) examines the Collective Agreement, approves it and authorizes the trade union committee of the Academy’s employees to sign the agreement with the rector on behalf of the labor team;

    4) elects a commission on labor disputes in accordance with the Code of Labor Laws of Ukraine;

    5) considers the issue of early termination of the powers of the rector of the Academy based on a substantiated submission of the Supervisory Board or the Academic Council of the Academy;

    6) based on a well-founded submission of the Academy’s structural divisions, considers the issue of electing representatives of scientific and pedagogical workers, other categories of workers to the Academic Council of the Academy, or their removal from the Academic Council of the Academy;

    7) approves the Rules of Internal Procedure of the Academy and the Collective Agreement;

    8) approves the Regulation on the scientific society of students, postgraduates, doctoral students and young scientists

    those;

    9) considers other issues of the Academy’s activities at the request of the rector, the Academic Council of the Academy, the trade union organization of Academy employees, the trade union organization of students and postgraduate students of the Academy, student self-government bodies.

    7.8. The body of public self-government of the educational and scientific institute, the body of public self-government of the faculty is the meeting (conference) of the labor team of the educational and scientific institute, the meeting (conference) of the labor team of the faculty, including elected representatives from among students studying at the educational and scientific institute of the Academy or at faculty of the Academy.

    7.9. Quantitative composition, standards of representation and the procedure for the election of delegates to meetings (conferences) of the work team of the educational and scientific institute, meetings (conference) of the work team of the faculty are determined, respectively, by the academic council of the educational and scientific institute or the academic council of the faculty in agreement with the management of the organization of the educational and scientific institute or faculty and student self-government bodies of an educational and scientific institute or faculty.

    At least 75 percent of the members of the meeting (conference) of the labor team of the educational and scientific institute, the meeting (conference) of the labor team of the faculty are scientific and pedagogical employees of the educational and scientific institute, scientific and pedagogical employees of the faculty, and at least 15 percent are elected representatives from the number of students who are elected by students through direct secret elections, and the rest – representatives of the auxiliary technical staff of the educational and scientific institute, representatives of the auxiliary technical staff of the faculty who work there on a permanent basis.

    Members of the meetings (conferences) of the work team of the educational and scientific institute, meetings (conferences) of the work team of the faculty may also be elected from among scientific and pedagogical workers of the Academy, who work at the Academy on a permanent basis, and whose activities are in the educational and scientific institute, at the faculty, they are carried out part-time or on the terms of hourly payment.

    Representatives from among the students of the educational and scientific institute, students of the faculty are elected to the meeting (conference) of the labor team of the educational and scientific institute, the meeting (conference) of the labor team of the faculty through direct secret elections, the procedure for which is determined by the Regulation on student self-government at the Academy.

    Representatives of the auxiliary and technical staff of the educational and scientific institute, auxiliary and technical staff of the faculty who work there on a permanent basis, are elected by the general meeting of the auxiliary and technical staff of the educational and scientific institute, by the general meeting of the auxiliary and technical staff of the faculty. The order of convening and norms of representation of this category of employees in meetings (conferences) of the labor team of the educational and scientific institute, in meetings (conferences) of the labor team of the faculty are determined, respectively, by the academic council of the educational and scientific institute, the academic council of the faculty.

    7.10. Meetings (conferences) of the work team of the educational and scientific institute, meetings (conference) of the work team of the faculty are convened at least once a year.

    7.11. Meetings (conference) of the work team of the educational and scientific institute, meetings (conference) of the work team of the faculty:

    1) consider issues of the development strategy of the relevant educational and scientific institute, faculty;

    2) listen to the annual report on the activity of the director of the educational and scientific institute, the dean of the faculty and evaluate it;

    3) approve the annual report on the activity of the educational and scientific institute, faculty;

    4) submit proposals to the rector of the Academy regarding the dismissal of the director of the educational and scientific institute, the dean of the faculty on the grounds provided for by the legislation of Ukraine, this Statute, the contract concluded with him;

    5) elect elected representatives to the academic council of the educational and scientific institute, the academic council of the faculty and consider the issue of their removal from the composition of the academic council of the educational and scientific institute, the academic council of the faculty;

    6) using the procedure of direct secret voting, put forward proposals to the Academic Council of the Academy regarding the candidacies of applicants for the position of head of the department;

    7) using the procedure of direct secret voting, put forward proposals to the academic council of the educational and scientific institute, the academic council of the faculty regarding candidates for election to the position of director of the educational and scientific institute, dean of the faculty;

    8) elect delegates from among the scientific and pedagogical workers of the educational and scientific institute delegates from among the scientific and pedagogical workers of the faculty to the general meeting (conference) of the working team of the Academy.

    7.12. Student self-government operates in the Academy and its structural divisions, which is an integral part of the public self-government of the Academy.

    7.13. Student self-government ensures the right and opportunity of students to decide the issues of education and life, respect for their rights

    and interests, as well as their participation in the management of the Academy.

    7.14. Student self-government unites all students of the Academy.

    All students studying at the Academy have equal rights and can elect and be elected to the public self-government bodies of the Academy and student self-government bodies (working, advisory, elective, etc.).

    7.15. Student self-government at the Academy is carried out at the level of a student group, course, educational and scientific institute, faculty, dormitory, Academy directly and through student self-government bodies, which are elected by direct secret ballot of students in the manner determined by the Regulations on student self-government at the Academy.

    7.16. Student self-government bodies are formed in accordance with the Law of Ukraine “On Higher Education”, this Statute and the Regulations on Student Self-Government of the Academy.

    In their activities, student self-government bodies are guided by the legislation of Ukraine, this Statute and the Regulations on Student Self-Government of the Academy.

    7.17. Student self-government bodies operate on the principles of:

    1) voluntariness, collegiality, openness;

    2) electability and reporting of student self-government bodies;

    3) equal rights of students to participate in student self-government;

    4) independence from the influence of political parties and religious organizations.

    7.18. The highest body of student self-government is the general assembly (conference) of students of the Academy.

    The bodies of student self-government of the Academy are created by the decision of the general meeting (conference) of students of the Academy in accordance with the Regulations on student self-government at the Academy.

    According to their purpose, student self-government bodies can be representative, executive, and control-auditing in nature.

    7.19. Representative, executive and control and audit bodies of student self-government are elected for a term of one year.

    7.20. Students elected to student self-government bodies can be recalled from their elected positions based on the results of a general secret vote of students. In order to initiate such a vote, it is necessary to collect the signatures of at least 10 percent of the students of the Academy.

    With the termination of a person’s studies at the Academy, his participation in the student self-government body is terminated in accordance with the procedure provided by the Regulations on Student Self-Government of the Academy.

    The head of the student self-government body and his deputies may hold office for no more than two terms.

    7.21. The following bodies of student self-government operate in the Academy:

    1) Student Academic Council of the Academy, Student Academic Councils of Faculties, Student Academic Councils of educational and scientific institutes, Institute of Starostat and other self-governing student organizations created in accordance with the legislation of Ukraine;

    2) Student Council of the Student Campus of the Academy;

    3) Scientific society of students, postgraduates, doctoral students and young scientists of the Academy.

    7.22. Bodies of student self-government:

    1) participate in the management of the Academy in accordance with the procedure established by the Law of Ukraine “On Higher Education” and this Statute;

    2) participate in the discussion and resolution of issues of improving the educational process, research work, awarding scholarships, organizing leisure time, health, living and nutrition;

    3) participate in measures to ensure the quality of higher education;

    4) promote educational, scientific and creative activities of students;

    5) promote the activities of student circles, societies, associations, and interest clubs;

    6) participate in cooperation with students of other educational institutions and international organizations;

    7) participate in solving issues of international exchange of students;

    8) conduct organizational, educational, scientific, sports, health and other events;

    9) protect the rights and interests of Academy students;

    10) delegate their representatives to working, consultative and advisory bodies;

    11) adopt acts regulating their organization and activity;

    12) participate in solving issues of ensuring proper living conditions for students living in dormitories and organizing students’ meals;

    13) dispose of funds and other property that are on the balance sheet and bank accounts of student self-government bodies;

    14) make proposals regarding the content of educational plans and programs;

    15) make proposals regarding the development of the Academy’s material base, including issues related to students’ daily life and recreation;

    16) have the right to announce protest actions by notifying the leadership of the Academy in the event that such actions are held at the Academy;

    17) perform other functions stipulated by the Law of Ukraine “On Higher Education” and the Regulations on Student Self-Government of the Academy.

    7.23. The student self-government bodies of the Academy take part in making important decisions regarding the functioning and development of the Academy.

    7.23.1. In agreement with the Student Academic Council, decisions are made on:

    1) expulsion of students from the Academy and their renewal

    for training;

    2) appointment to the positions of vice-rectors of the Academy, deputy directors of institutes, deputy deans of faculties;

    3) approval of the Rules of Internal Procedure of the Academy in the part that concerns persons studying at the Academy;

    4) accommodation of persons studying at the Academy in the dormitory and their eviction from the dormitory;

    5) activities of student campuses and dormitories for the residence of persons studying at the Academy.

    7.24. General meeting (conference) of students of the Academy:

    1) adopts the Regulations on student self-government of the Academy, determines the structure, powers and the Procedure for holding direct secret elections of representative and executive bodies of student self-government;

    2) listens to the reports of representative, executive and control and audit bodies of student self-government, gives them an appropriate assessment;

    3) approves the procedure for using property and funds of student self-government bodies, supporting student initiatives on a competitive basis;

    4) approves the annual cost estimate (budget) of student self-government bodies, makes changes and additions to it, listens to the report on its implementation;

    5) elects a control and audit commission from among students to carry out current control over the state of property use and implementation of the budget of student self-government bodies.

    7.25. The Student Academic Council can be registered as a public organization in accordance with the legislation of Ukraine, taking into account the features established by the Law of Ukraine “On Higher Education” and this Statute.

    7.26. The management of the Academy has no right to interfere in the activities of the student self-government bodies, except in cases where such activities contradict the legislation, this Statute or harm the interests of the Academy.

    7.27. The rector of the Academy ensures proper conditions for the activities of student self-government bodies (provides premises, furniture, office equipment, provides telephone communication, permanent access to the Internet, allocates places for the installation of information stands, etc.), on which a corresponding agreement is concluded.

    7.28. The financial basis of the activity of student self-government bodies is:

    1) funds determined by the Academic Council of the Academy in the amount of not less than 0.5 percent of own revenues received by the Academy from the main activity;

    2) membership fees of students, the amount of which is established by the general meeting (conference) of students of the Academy. The size of the monthly membership fee of one person cannot exceed 1 percent of the subsistence minimum established by the legislation of Ukraine.

    Funds of student self-government bodies are directed to the fulfillment of their tasks and the exercise of powers in accordance with the estimates approved by them.

    Student self-government bodies publicly report on the use of funds and the implementation of estimates at least once a year in accordance with the procedure established by the legislation of Ukraine.

    7.29. Bodies of student self-government of the Academy, educational and scientific institutes, faculties:

    1) take measures to ensure compliance with the rights and legitimate interests of the students of the Academy in matters of ensuring the quality of education through appeals to the public self-government bodies of the Academy, to the leadership of the Academy, to state and local self-government bodies, to student and public organizations, etc.;

    2) participate in the management of the Academy in matters of organization and provision of the educational process in accordance with the procedure established by the Law of Ukraine “On Higher Education” and this Statute;

    3) participate in the discussion and resolution of issues of modernization and improvement of the educational process;

    4) delegate their representatives to public self-government bodies of the Academy, public self-government bodies of the faculty, public self-government bodies of the educational and scientific institute;

    5) adopt acts regulating their organization and activity;

    6) make proposals regarding the content of educational (educational-professional, educational-scientific) programs, improvement of curricula and modernization of programs of educational disciplines;

    7) make proposals for the development of the Academy’s material base on issues related to the organization and provision of the educational process;

    8) contribute to the formation of moral and ethical standards in students, education of humanism, promotion of a healthy lifestyle, safe behavior, prevention of students from committing offenses;

    9) promote the development of international student cooperation, organize joint events with student representatives of foreign educational institutions;

    10) inform and make proposals to public self-government bodies, management, other officials of the Academy regarding the actions or inaction of officials and officials of the Academy in the event of restrictions, violations or prevention of violations of the rights and legitimate interests of students of the Academy;

    11) systematically inform the students of the Academy and report to them on the results (current and annual) of their activities, including financial ones;

    12) interact with all public self-government bodies and structural units of the Academy on

    ensuring compliance with the rights and legitimate interests of students, modernization and improvement of the educational process;

    13) perform other functions stipulated by the legislation of Ukraine and the Regulation on student self-government at the Academy.

    7.30. The tasks, functions and specifics of the activity of other student public organizations are defined in the relevant regulations on the work of these organizations.

    7.31. The scientific society of students, postgraduates, doctoral students and young scientists of the Academy is part of the public self-government system of the Academy.

    7.32. Persons under the age of 35 (for doctoral students – 40 years old) who study or work at the Academy participate in the work of the scientific society of students, post-graduate students, doctoral students and young scientists.

    7.33. The scientific society of students, postgraduates, doctoral students and young scientists ensures the protection of the rights and interests of persons who study or work at the Academy, in particular with regard to issues of scientific activity, support of science-intensive ideas, innovations and exchange of knowledge.

    7.34. In its activities, the Scientific Society of Students, Postgraduate Students, Doctoral Students and Young Scientists is governed by the legislation of Ukraine, this Statute and the Regulations on the Scientific Society of Students, Postgraduate Students, Doctoral Students and Young Scientists of the Academy.

    7.35. The scientific society of students, postgraduates, doctoral students and young scientists operates on the principles of:

    1) freedom of scientific creativity;

    2) voluntariness, collegiality, openness;

    3) equality of the right of students to participate in the activities of the Scientific Society of students, postgraduates, doctoral students and young scientists of the Academy.

    7.36. Scientific society of students, postgraduates, doctoral students and young scientists of the Academy:

    1) adopts acts regulating its organization and activity;

    2) conducts organizational, scientific and educational events;

    3) popularizes scientific activity among student youth, promotes the involvement of students in scientific work and innovative activities;

    4) represents the interests of students, postgraduates, doctoral students and young scientists before the administration of the academy and other organizations in matters of scientific work and academic career development;

    5) contribute to improving the quality of scientific research;

    6) promote the exchange of information between young scientists and researchers;

    7) promote the development of inter-university and international cooperation;

    8) interact with the National Academy of Sciences of Ukraine and national branch academies of sciences, scientific and research institutions;

    9) perform other functions provided for by the legislation of Ukraine and the Regulations on the Scientific Society of Students, Postgraduate Students, Doctoral Students and Young Scientists of the Academy.

    7.37. In agreement with the Scientific Society of Students, Postgraduate Students, Doctoral Students and Young Scientists, the Academy’s management makes a decision to expel persons who have obtained the degree of Candidate of Sciences (Doctor of Philosophy) from the Academy and to resume their studies.

    7.38. The management bodies of the Scientific Society of students, postgraduates, doctoral students and young scientists of the Academy are formed on a democratic basis through elections. The structure of the Scientific Society of students, postgraduates, doctoral students and young scientists of the Academy and the organizational mechanism of its activity are determined by the regulations approved by the general meeting (conference) of the Academy’s work team.

    7.39. The financial basis of the activity of the Scientific Society of students, postgraduates, doctoral students and young scientists of the Academy is the funds determined by the Academic Council of the Academy.

    INTERNATIONAL COOPERATION AND FOREIGN ECONOMIC ACTIVITIES

    8.1. The Academy carries out international cooperation, concludes cooperation agreements, establishes direct relations with institutions of higher education, scientific institutions and enterprises of foreign countries, foreign citizens, international organizations, foundations, etc. in accordance with the legislation.

    8.2. The main areas of international cooperation of the Academy are:

    – participation in programs of bilateral and multilateral interstate and interacademic exchange of students, post-graduate students, doctoral students, pedagogical, scientific-pedagogical and scientific workers;

    – organization of international conferences, symposia, congresses and other events;

    – participation in international educational and scientific programs;

    – joint publishing activity;

    – provision of services related to higher and post-graduate education to foreign citizens in Ukraine, as well as preparation of foreign citizens for admission to higher education institutions of Ukraine;

    – organization of joint training and internship of education seekers;

    – creation of joint educational and scientific programs with foreign higher education institutions, scientific institutions, organizations;

    – performance of scientific works under grants initiated by foundations of foreign states and international organizations;

    – conducting joint scientific research and projects;

    – travel abroad of pedagogical, scientific-pedagogical and scientific workers for pedagogical, scientific-pedagogical and scientific work in accordance with international agreements of Ukraine, as well as agreements between such higher education institutions and foreign partners;

    – the involvement of pedagogical and scientific pedagogues

    academic, scientific workers of foreign higher education institutions to participate in pedagogical, scientific-pedagogical and scientific work in higher education institutions of Ukraine;

    – referral of persons studying at higher education institutions of Ukraine to study at foreign higher education institutions;

    – promotion of academic mobility of scientific, scientific-pedagogical workers and students;

    – implementation of various types of foreign economic activity provided for by the current legislation of Ukraine;

    – other directions and forms not prohibited by law.

    8.3. Training and retraining of specialists, scientific personnel for foreign countries, preparation of foreign citizens for admission to higher education institutions is carried out according to interstate agreements of Ukraine, as well as agreements concluded by the Academy with authorities, organizations, firms, higher education institutions of other countries, foreign citizens and international organizations.

    8.4. Foreign currency and material income from foreign economic activities are used by the Academy to ensure its statutory activities in accordance with its own budget and in accordance with the legislation of Ukraine.

    8.5. The foreign economic activity of the Academy is carried out in accordance with the legislation, through the conclusion of contracts with foreign legal entities and individuals.

    8.6. The main areas of foreign economic activity of the Academy are:

    – organization of preparation of persons from the circle of foreign citizens to enter the higher education institutions of Ukraine and persons from the circle of Ukrainian citizens to study abroad;

    – implementation of educational activities related to the training of foreign students according to accredited educational programs, as well as the training of scientific personnel for foreign countries;

    – organization of study abroad;

    – performing scientific research and scientific and technical developments.

    8.7. The foreign exchange revenue is credited to the currency account of the Academy in accordance with the procedure established by the current legislation of Ukraine, and is used to finance activities that comply with the Statute of the Academy.

    8.8. The Academy has the right to receive loans, grants, assistance, etc. from its foreign partners.

    PROPERTY and funds of the ACADEMY

    9.1. The material and technical base and finances of the Academy consist of fixed assets, working capital and other material and financial assets, the value of which is reflected in the independent balance sheet.

    9.2. The Academy has the right of ownership in relation to:

    9.2.1. funds, property, other property, transferred by the Founder (Founders) to the authorized capital of the Academy;

    9.2.2. funds, property, other property, transferred by its Founders, individuals and (or) legal entities in the form of gifts, donations or by will;

    9.2.3. funds from own activities and property objects purchased with them;

    9.2.4. funds received as compensation for training costs;

    9.2.5. funds from the sale and sale of printing and other educational and scientific products, as well as fees for renting premises, buildings, and equipment.

    9.3. The authorized capital of the Academy is 50,000 (fifty thousand) hryvnias, 00 kopecks, due to the contribution of the Founder.

    9.3.1. Citizen of Ukraine – Pakhlevanzade Alborz, taxpayer identification code 3406111195.

    9.4. The authorized capital of the Academy includes property and working capital.

    9.5. The Academy independently owns, uses and disposes of funds and property acquired at the expense of revenues received as a result of economic or scientific research activities, as well as at the expense of charitable and voluntary contributions of individuals and legal entities.

    9.6. Funding of the Academy’s activities is carried out at the expense of:

    9.6.1. funds of the Founder (Founders), including contributions to the authorized capital;

    9.6.2. funds received for training, retraining, certification and advanced training of personnel in accordance with concluded agreements and the provision of other paid services received as a cover for training costs;

    9.6.3. funds received for the performance of scientific research works and expert services on the order of legal entities and individuals;

    9.6.4. use of deductions of divisions, firms, enterprises created with the participation of the Academy;

    9.6.5. income from the use or lease of premises, buildings, equipment, etc.;

    9.6.6. credits and loans of banks, currency receipts, deposits and income from them, dividends received from securities;

    9.6.7. voluntary monetary contributions and donations, material values received from organizations and individual citizens;

    9.6.8. income received from the use of the Academy’s symbols;

    9.6.9. other sources of income not prohibited by law.

    9.7. Funds, material values and intangible assets received free of charge in the form of non-refundable financial aid or voluntary donations of legal entities and individuals, including non-residents, to the Academy for educational, scientific, educational, recreational, sports, cultural activities are not considered income and are not taxable .

    9.8. Taxation of funds received by the Academy from economic activity is carried out in the manner and amounts established by current legislation.

    9.9. All funds received by the Academy must be used according to budget

    isom for reimbursement of material and equivalent costs, payment of wages, material incentives, maintenance and renewal of fixed assets, social development in accordance with the current legislation of Ukraine.

    9.10. Funds in foreign currency received from non-residents of Ukraine to cover educational expenses and other types of activities are kept in the currency account of the Academy.

    9.11. The Academy independently determines the necessary amount of fixed and working funds.

    9.12. The Academy independently organizes operational and accounting records, conducts statistical reporting in accordance with the established norms, submits it in the established order to the bodies that are granted the right to control the relevant areas of activity by the legislation of Ukraine, ensuring timely and complete accounting and storage of funds and material assets that come from all sources, their intended use with the submission of appropriate reports, established by law, to the relevant state authorities.

    9.13. The estimate of income and expenses of the Academy is formed according to sources and expenses (targeted allocation), adopted by the academic council, approved by the Founder (Founders), signed by the rector of the Academy, made public in accordance with the procedure established by the legislation of Ukraine.

    9.14. The rector and the chief accountant bear personal responsibility for the targeted use of funds under the articles of the Academy’s unified estimate of income and expenses.

    9.15 The chief accountant is responsible to the rector for the implementation of the articles of the Academy’s estimate and informs the academic council quarterly about the implementation of the Academy’s income and expenditure estimate.

    9.16 The income of the Academy is used to finance expenses for the maintenance of the Academy, the realization of the purpose (goals, tasks) and directions of activity defined by this Statute.

    9.17 The Academy is prohibited from distributing the received income (profits) or their part among the Founders, employees of the Academy (except for payment of their labor, calculation of a single social contribution), the management body and other related persons.

    9.18. In accordance with the legislation of Ukraine and the Charter, the Academy may provide paid services to individuals and legal entities.

    Paid educational services can be provided by the same structural units that carry out the educational process under the state order, or by separate structural units of the academy formed to provide paid services, acting on the basis of a provision approved in accordance with the legislation and this Charter.

    9.19. The Academy independently disposes of income and other receipts received from the provision of paid services permitted by the legislation of Ukraine. Such an order includes the right to open current and deposit accounts in banks, keep funds in bank deposit accounts, the right to purchase property and use it on the basis of contracts, etc.

    Funds received by the Academy as fees for training, training, retraining, advanced training of personnel, for the provision of educational services and other services cannot be withdrawn from the income of the state or local budgets.

    Funds in foreign currency received from non-residents to cover educational expenses and other types of activities are kept in the currency account of the Academy.

    Funds received by the Academy are used in accordance with the approved budget classification.

    9.20. The amount of the fee for the entire period of study for obtaining the corresponding degree of higher education, professional development, including the production of the document on education and its annexes, as well as the procedure for paying for the educational service (one time, every year, every semester, every month) are established in the contract (contract) concluded between the Academy and the physical (legal) person who orders a paid educational service for himself or for another person, assuming financial obligations regarding its payment.

    A standard contract concluded between the Academy and a physical (legal) entity that orders a paid educational service for the duration of training is approved by the central executive body in the field of education and science.

    9.21. The amount of fees for the entire period of study for obtaining the corresponding degree of higher education, advanced training is established by the Academy in the national currency of Ukraine (except for obtaining higher education, advanced training by foreigners).

    The amount of fees for the entire period of study or for the provision of additional educational services is published in the mass media, on the official website, on information stands and in any other way.

    9.22. The Academy, within the budget, provides the conditions for the independent development of the labor team, provided for in the Collective Agreement.

    Payment of labor at the Academy is carried out in accordance with the current labor legislation of Ukraine, the Laws of Ukraine “On Education”, “On Higher Education”, normative legal acts of the Cabinet of Ministers of Ukraine, orders of the Ministry of Education and Science of Ukraine, inter-industry, industry agreements, Collective Agreement, contracts, contracts of a civil law nature.

    9.23. The scholarship fund of the Academy is used in accordance with national funds

    normative acts and documents of the Academy;

    9.24. The Academy, within the limits set by the legislation of Ukraine and in accordance with this Statute, has the right to:

    1) receive funds and material assets (houses, buildings, equipment, vehicles, etc.) from state authorities, enterprises, institutions, organizations (including charities) and individuals;

    2) conduct financial and economic activities in Ukraine and abroad;

    3) to create their own or to use other material and technical bases under the contract to carry out educational and industrial practice of persons studying at the Academy, as well as for their own economic activities;

    4) to develop one’s own social and household base, a network of sports and recreation, treatment and prevention, and cultural institutions;

    5) to carry out capital construction, reconstruction, capital and ongoing repair of fixed assets on contract terms or in an economic way;

    6) allocate funds for the construction or improvement of social and household facilities, as well as for social support of pedagogical, scientific and pedagogical and other categories of employees of the Academy and persons studying at the Academy.

    9.25. The Academy has the right to benefit from tax, fees, customs payments, other payments to the state and local budgets established for higher education institutions by the Tax Code of Ukraine and other legislative acts.

    AMENDMENTS TO THE STATUTES OF THE ACADEMY

    10.1. Amendments to this Statute (a new edition of the Statute) are adopted by the conference of the Academy’s labor team, approved and signed by the Founder(s) of the Academy, and enter into force from the moment of their state registration.

    10.2. The Statute of the Academy, approved and signed by the Founders of the Academy, is valid indefinitely.

    10.3. Issues not regulated by this Statute, the Academy is governed by the current legislation of Ukraine and other internal acts of the Academy.

    PROCEDURE FOR REORGANIZATION AND LIQUIDATION OF THE ACADEMY

    11.1. The decision on reorganization (merger, merger, division, transformation) or liquidation of the Academy is adopted by the Founder or the General Meeting of the Founders of the Academy.

    11.2. In the event of reorganization (merger, division, merger, transformation) of the Academy, all of its rights and obligations are transferred to its successors.

    11.3. The liquidation (reorganization) of the Academy is carried out by the liquidation commission (reorganization commission) appointed by the Founder (Founders) of the Academy. The powers of all management bodies of the Academy are transferred to the liquidation commission. The term of liquidation and the procedure for meeting the demands of creditors are determined by the Founder(s) of the Academy in accordance with the legislation of Ukraine.

    11.4. Reorganization or liquidation of the Academy should not violate the rights and interests of persons studying at the Academy. The responsibility for solving all issues of the continuous acquisition of higher education by such persons rests with the Founder(s) of the Academy.

    11.5. In the event of termination of the Academy (as a result of liquidation, merger, division, merger or transformation), the assets of the Academy remaining after the satisfaction of creditors’ claims (including taxes, fees, a single contribution to mandatory state social insurance and other funds due to state or local budget, the Pension Fund of Ukraine, social insurance funds), are distributed by the liquidation commission between the founder(s) of the Academy in proportion to their share in the authorized capital of the Academy. Assets and property of the Academy acquired by the Academy after the adoption of changes in the Tax Code of Ukraine (Law of Ukraine No. 652-VIII dated 17.07.2015) are transferred by the liquidation commission to another non-profit institution (organization) of the corresponding type on the terms determined by the Founder (Founders).

    11.6. The Academy is considered to be reorganized or liquidated from the date of entry into the Unified State Register of Legal Entities, Individual Entrepreneurs and Public Organizations of the termination of its activity.
